RE: REPLY REQUESTED Special Session - Health Care Freedom Act and Join suit against ObamaCare

Dear Representative/Senator,
I am writing to you in regard to the calling of a special session to pass The Healthcare Freedom Act amendment to the Wyoming constitution and to join the federal lawsuit against the unconstitutional Patient Protection and Affordable Care Act (Obamacare) - to protect the rights of the citizens of Wyoming and the sovereignty of the state of Wyoming.
Since the passage of Obamacare in March the AG's office and the Governor's office have been inundated with calls directing them to protect the rights of the citizens of Wyoming. Both the Attorney
General and the Governor have chosen to do nothing. They are apparently of the opinion that Government has the right to mandate the citizens of Wyoming to purchase commercial products.
The commerce clause and the 10th Amendment of the US Constitution are under attack. Obamacare mandates that Wyoming citizens purchase a commercial product. In this specific case it is health
insurance. Obamacare also imposes a fine, if a Wyoming citizen does not purchase a federally mandated commercial product.
States across the country are presently addressing these issues in two ways. States are passing Healthcare Freedom Act amendments to their state constitutions or as bills. At last count 18 States are
filing suit against the Federal Government and the Patient Protection and Affordable Care Act.
During the 2010 Budget Session, the Health Care Freedom Act, an amendment to the Wyoming Constitution, failed introduction. The language of the Health Care Freedom Act "preserves the right of all
persons to make their own health care decisions" expressly protecting the citizens of Wyoming from mandated health care and any associated fines. Even though polls showed that a majority of
Wyomingites supported this constitutional amendment it failed introduction.
Similarly, the eighteen states bringing suit against the Federal Government are basing their arguments on the fact that "the Constitution nowhere authorizes the United States to mandate, either
directly or under threat of penalty, that all citizens and legal residents have qualifying healthcare coverage." The states also argue that "the tax penalty required under the Act, which must be paid
by uninsured citizens and residents, constitutes an unlawful capitation or direct tax" violating the Constitution. Here again, a majority of Wyomingites support the repeal of Obamacare!
As you know, there are three ways a special session can be called. The Governor, the President of the Senate and the House Speaker, and the two chambers can call a special session. In the case of the
President of the Senate and the House Speaker, and the two chambers 50% is required to call a special session. The cost of a 5 day special session is $185,000 - or 37cents per Wyoming citizen.
My questions to you:
1. Do you support the calling of a special session?
2. If yes, will you actively pursue your fellow legislators to vote yes for a special session?
3. If yes, will you pursue your fellow legislators to ensure that the two pieces of legislation are passed with a veto-proof majority?
4. If you do not support calling a special session please explain why.
