April 24th Letter to Legislators
RE: Wyoming Republicans lack of leadership results in failure to protect sovereignty
Dear Representative/Senator,
It's official, Wyoming's republican party has no leadership. Collin Simpson and John Hines, two big government republicans, have chosen to go the way of Harry Ried, Nancy Pelosi and President Obama. Trample on the will of the people; ignore the fact that the right to govern is solely based on the consent of the governed.
Collin Simpson and John Hines oppose the calling of a special session to protect Wyoming's sovereignty and the rights of her citizens. link
In 1788 in Federalist Paper 55, James Madison "was unable to conceive that the State legislatures, which must feel so many motives to watch, and which possess so many means of counteracting, the federal legislature, would fail either to detect or to defeat a conspiracy of the latter against the liberties of their common constituents." Two hundred and twenty two years later our founding father would be provided an example of a state legislature - the Wyoming state legislature - who willingly and with open eyes overlooks and stands by fecklessly, casting aside the many means at its disposal to counteract the federal legislature's conspiracy against the liberties of the citizens of Wyoming.
House Speaker Simpson and Senate President Hines have full knowledge of the means at their disposal to defend Wyoming's sovereignty and the rights of Wyoming citizens. There is no ambiguity in the fact that the federal legislature is conspiring against the liberties of Wyoming and her citizens. Yet both men, who swore a solemn oath to obey and defend the Constitution of the United States and discharge the duties of his or her office with fidelity, have decided to fight another day. Demosthenes coined this phrase, he was a Greek statesman and a coward, who facing overwhelming odds in a battle chose to desert his fellow rank and file soldiers to, as he stated, fight another day.
Thirty eight states have taken up the torch to illuminate, detect, and defeat the "ambitious encroachments of the federal government, on the authority of the State governments." The unconstitutional mandates and fines imposed by the Patient Protection and Affordable Care Act has not "excite(d) the opposition of a single State, or of a few States only". The encroachments of the federal government has "signal(ed) a general alarm". And James Madison continues in Federalist Papers 44 "Every (state) government (has) espouse(d) the common cause". And as he firmly believed "A correspondence (has been) opened (among the states). Plans of resistance (have been) concerted. And most importantly "One spirit... animate(s)... the conduct (of) the whole".
In the spirit of "the whole", President Hines states in a recent article "if the states' lawsuit is successful, Wyoming will reap the benefits anyway" and he pointed out "there's no reason not to wait until next year's general session or beyond to take any action in response to the federal reforms." This places a new spin on "to fight another day"- not only does one desert - one allows others to battle in one's stead. Machiavelli would be proud of Senator Hines' skill in squaring a circle. As for House Speaker Simpson, no reason has been given for his opposition.
Now it is up to Wyoming's legislature. Will it choose to act in accordance with the spirit that is animating the actions of the whole and join in action with the other 38 states or will it act in a manner which Madison was unable to conceive and "fail either to detect or to defeat a conspiracy of the (federal legislature) against the liberties of their common constituents."
Let there be no doubt a vast majority of Wyoming citizens demand action which strongly reflects the "spirit of the whole". Wyoming citizens have identified the "common cause" we share with all other states and our duty to pull our own weight.
The vast majority of Wyoming citizens support the calling of a special session to pass legislation appointing a special legal counsel to join the lawsuit against the federal government and support the Health Care Freedom Act - the amendment to the Wyoming constitution. These two means of counteracting federal encroachment protect Wyoming as follows: the Healthcare Freedom Act "preserves the right of all persons to make their own health care decisions" expressly protecting the citizens of Wyoming from mandated health care and any associated fines and the lawsuit fights the unconstitutionality of the mandates and fines stating "the Constitution nowhere authorizes the United States to mandate, either directly or under threat of penalty, that all citizens and legal residents have qualifying healthcare coverage". (Amendments to the Wyoming Constitution can only be placed on the ballot during a general election, in other words if we do not pass it this year - we will not have another opportunity until 2012.)
So once again:
1. Do you support the calling of a special session?
2. If yes, will you actively pursue your fellow legislators to vote yes for a special session?
3. If yes, will you pursue your fellow legislators to ensure that the two pieces of legislation are passed with a veto-proof majority?
4. If you do not support calling a special session please explain why.

Thank you in advance for your response.
